Chodzi o swobodę przepływu osób (co wielu prawicowców błędnie utożsamia ze strefą Schengen). Jeśli mamy prawo się osiedlić w kraju A, to kraj A nie może nam utrudniać życia, gdyż pochodzimy z kraju B. Do tego sprowadza się to orzeczenie.
