HR departments countrywide need to start treating gendercrit employees as potentially hostile. As soon as you are required to interact with one, you dust off the rulebook, you dot every eye and cross every t, and you assume bad faith at every turn.

They are a threat to every organisation.

My stab at a letter wrt the BBC News at Ten.

Haven't got into the details of the press summary though.
Ms Peggie Vs NHS Fife tribunal decision reporting.  BBC News at Ten, 8th December 2025 I wish to register a complaint with regards to the reporting of the referenced case (the tribunal decision in the case of Ms Peggie Vs NHS Fife) The complaint specifically refers to the broadcast on Monday 8th December, starting at 22:14, and concerns three key areas: Reporting standards regarding the appropriate, respectful and impartial description of members of the transgender community Reporting on the conduct of the complainant (Ms Peggie), as found by the tribunal Reporting standards regarding the appropriate, respectful and impartial description of members of the transgender community During the report: Fiona Bruce) describes Dr. Upton as having been "...born as a biological male but identifies as a woman..." The Scotland Correspondent (Lorna Gordon) similarly describes Dr. Upton as “...transgender, a biological male who identifies as a woman. Notwithstanding the ruling of the For Women Scotland Supreme Court case, transgender women (and men) are a clearly defined group with respect to UK law. For reporters to use the phrase as in this report (and which has been noted in other reporting on both BBC TV news and the BBC news website) explicitly sets transgender identity in the position of a contestable ideology, as opposed the reality in both established biological fact and UK law. The use of this description denies the transgender community of their existence which is no less valid than that of the rest of the population - cisgender individuals included. As such, this phrasing in now understandably being viewed by the transgender community as a direct insult. Where not used as direct quotes (e.g., a direct statement from an interviewee), use of this term in BBC reporting (in this and other reports) therefore fails to adhere to BBC rules on impartiality. This is an issue that I have raised with previous BBC reporting, and which are still under consideration (Complaints Reference CAS-8256983-D0F7B8). I am also aware of other instances of reports on the topic of transgender individuals and the community as a whole, so it would appear to be an issue that is replicated more widely across BBC news reporting. As such, I would like you to consider this complaint as covering both the report as described above, and the overall BBC news reporting of the transgender community. The aforementioned report extensively reports on the complaints upheld by the tribunal in favour of Ms Peggie, whilst briefly mentioning that all complaints made by Ms Peggie against Dr. Upton were dismissed. At no point, however, does the report discuss the findings by the tribunal that Ms Peggie had behaved in such a way towards Dr. Upton, as to be “...in our view what amounted to an incident of harassment...”, that Dr Upton was entitled to view the actions of Ms Peggie “...as a hate incident...” and that these actions construed a breach of Dr. Upton’s Article 8 rights (Right to respect for private and family life, European Court of human Rights). These findings – that Ms Peggie was in fact adjudged to have engaged in harassment of Dr. Upton, have material implications with regards the basis for the complaints made by Ms Peggie against Dr. Upton and on what should be the appropriate balance of reporting around the two individuals in this case and the dispute which resulted in elements of this case coming to tribunal. My complaint therefore is that the the BBC, in reporting as broadcast failed in to adhere to BBC rules on impartiality with regard to the defendent Dr. Upton. Thank you, and I look forward to your response.

The first respondent harassed the claimant contrary to section 26(1) of the Equality Act 2010 ("the Act") by: (a) failing to revoke the grant of permission to the second respondent to use the female staff changing room of the Emergency Department of Victoria Hospital, Kirkcaldy from on and after 16 September 2023 until the claimant returned to work on 14 April 2024 when rota arrangements were made such that the claimant and second respondent were not working together at the same time, as a result of which the second respondent entered the said changing room when the claimant was present on 25 October 2023 and the claimant entered it when the second respondent was present for a period over midnight on 24-25 December 2023; (b) taking an unreasonable length of time to investigate the second respondent's allegations against the claimant in the period from its commencement on 5 January 2024, a reasonable period of time to do so being not more than six months; (c) making reference to patient care allegations against the claimant on 28 March 2024; and (d) giving an instruction to the claimant on 5 July 2024 not to discuss the case, until a further message on 22 July 2024 confirmed that that applied only to the investigation.

An important point to come out of the Sandie Peggie case is that 'gender critical' employees can't take matters into their own hands and confront trans employees. If they do that it is likely to be harassment/ bullying/ a hate incident.
So far as her other comments are concerned, they were impermissible manifestations of her belief and were in our view what amounted to an incident of harassment by the claimant of the second respondent related to the protected characteristic of gender reassignment, reasonably perceived by the second respondent to be so, and were a breach by the claimant of section 26 of the Act and of the Bullying and Harassment Policy. The second respondent was entitled to view the actions of the claimant in those particular regards as being such harassment, or as a “hate incident” within the policy, and the first respondent was entitled in principle to act on the complaint made, but the detail of how it did so depends on all the circumstances as more fully addressed below. The second respondent was also entitled to regard the claimant’s actions as a breach of the second respondent’s Article 8 rights, so far as the claimant’s expression of her beliefs was impermissible. 1034. We also considered that the claimant had acted deliberately to be able to challenge the second respondent whilst they were alone. What she did was to wait until other members of staff had left the changing room, and for the second respondent to leave the cubicle, before raising her own beliefs directly with the second respondent in the manner we have set out. 1035. Whilst the claimant had not been informed as promptly and in the detail we considered appropriate, and the first respondent did not consider whether to revoke permission at all, the claimant did not herself raise any formal grievance under the policy. She is an experienced member of staff who had access to union advice. She knew, or ought reasonably to have known, that the first respondent having granted permission to the second respondent she required to have raised her concerns with the first respondent as the decision-maker rather than with the colleague to whom it had been granted, and in any event ought not to have done so in the manner that she did.

You know, infuriating and a shameful betrayal though the BBC and other media's misreporting of the Sandie Peggie judgment is, it also doesn't really matter.

What matters is the judgment which lawyers will read, use to advise their clients, and inclusion will be the winner.
