this goes to the bigger issue of SenateBrain, that it's a rarefied club with rules and subtleties to complex for us non-senators to understand and what the senate should do is above voters and non-senators pay grade. that attitude is the kernel problem.

Honestly, this is the crux of Trumpism: The argument that the government and its agents should be allowed to break the law without consequence. They don't understand why they shouldn't be allowed this, nor do they care to understand.
what's so crazy-making about this oral argument (which I'll write about when it's done) is that the GOP justices are saying 'yes the officials knew they were violating his rights, but they didn't know they could be *sued and have to pay $$ for that, seems unfair'

Justice Jackson’s 48-hour clock started just before midnight Sunday, meaning the administrative stay she issued Friday ends at the end of the day Tuesday.

Shutting down the government is a big deal. People have been hurt in big ways as a result of the decision. To have that suffering be for nothing—to re-open the government without actually having protected people’s health insurance and economic well-being—is unconscionable.

i think this is key. taking the deal would amount to taking the blame. it would turn a clear political victory into an unambiguous defeat.
If the Dems blink after all of this, for a deal that all but ensures no ACA subsidies in 2026 anyway, then what was the purpose of letting the shutdown go for 40 days in the first place?
