Originalism has coherence as an abstract legal theory.

In practice in the Roberts court, it means BS to get to a policy outcome, distorting and ignoring the text and contemporary explanations as needed.

So I’ll believe “conservative lawyer makes strong originalist argument” matters when I see it.

It's striking that even in the defenses of Bari Weiss's broader thing no one ever says that she or her website does good work. I’m glad, but make no mistake: rerouting funding to an organization means they are washing their hands of administering this.

Meaning if there’s abuse, they will not be investigating. Meaning this is yet another step towards privatization of education, particularly for disabled students.
