No, the discrepancy is between morality and reality. Of the 4 people in in the eg, only JHW took force, or was at risk of bodily harm. Here in NH, the form of an act is of greater, or at least equal value to the reality of an act. Threat to kill someone is the same as trying to kill someone. 2/
