Having read the excerpted language by the judge, I agree. This isn’t just a statement by an agency. It’s a contract they’re trying to get the schools to agree with illegal conditions in it. So my ignorance of the context meant I had an inadequate understanding of this. Thanks for disagreeing!

Agree. At least the many, many folks on H visas already have some respite from anguish. I hope. We should honestly allow everyone spending more than 6 months here to get driver’s licenses etc, else what are we even doing?

Good question. It’ll be attacked in court and it’s contrary to the statute, which would be enough to defeat it in normal times. They’ve said it won’t be enforced against doctors, which is I guess nice or something. But law should be LAW, not whim or by grace.

So a lawyer might answer: maybe no?

I’ve never done one. The rules seem overly complex, unnecessary obstacles for such a straightforward benefit. Gaming of visas by companies is a thing, and I favor worker power as an alternative approach. But, not my area.

Immigration shouldn’t harm workers. Immigration doesn’t harm America.

Aaron, I was told in no uncertain terms that immigration lawyers only prey upon the H visa community. If that’s true, why are we celebrating the survival of a humane and reasonable fix that helps people?

Friendly amendment that other things they want to do is punish universities, install friendly bosses of news orgs and mass media, execute people, dismantle major institutions, eliminate food aid and make people sicker. But they don’t need to build to do those.

I mean, looking at that 2022 post, it wasn’t struck down? They just continued their project of eliminating recourse for violations? Miranda warnings still exist and still matter as far as exclusionary rulings in criminal proceedings?

The actual answer is that immigration arrests by ICE of noncitizens don’t require Miranda warnings because it’s not a criminal arrest.
