The gist from the Court here is that because the grand jury refused to indict them over the entirely fabricated claims, the criminal process did not get far enough to constitute a deprivation of liberty. Just deprivation of their future football careers, educations, and reputations.

6th Cir. holds that the harms to five black UK football players who were falsely accused of crimes after they were subjected to racist taunts by white frat boys at a school party do not constitute deprivations of liberty under the Fourteenth Amendment.

The parties dispute the third element: deprivation of liberty. According to plaintiffs, they
have been deprived of liberty because they suffered (1) a threat of imprisonment; (2) being
summoned for an arraignment and compelled to testify before a grand jury; (3) the seizure of
their personal property and information; (4) student misconduct hearings; (5) the loss of
educational and athletic opportunities; (6) reputational harm; and (7) emotional distress.
Plaintiffs have suffered greatly in general, and we are without doubt that the allegations
contained in plaintiffs’ complaints are deeply troubling and, if true, reflect extremely poorly
upon the state actors involved. But not every horrible occurrence is a constitutional violation and
plaintiffs’ suffering cannot be appropriately framed as a “deprivation of liberty” under the Fourth
Amendment as understood by this court and the Supreme Court.

Years and years ago, I knew an attorney who needed to buy an extra day or two for briefing, and the 2d Cir., which is notoriously stingy about extensions, would automatically bounce a brief with incomplete tables and order that it be refiled w/in 48 hours. You can see where this went.

RFK fired the CDC official (w/decades of experience) leading the measles outbreak response. It's been decades since we've had such a large outbreak. And just to ensure they they can spread the measles outbreak even farther, they also fired the leadership for the center focused on immunization.

#BREAKING The 7th U.S. Circuit Court of Appeals PARTIALLY grants the stay sought by the Trump Administration.

The stay is GRANTED as to federalization of the National Guard.

But it is DENIED as to deployment.

So deployment still BLOCKED, but troops "do not need to return to their home states."

ICE left David, a 17-year-old boy, stranded on the side of Interstate 20 after pulling over his immigrant father, Hector, in Mississippi.

David began running in the scorching sun after the car and watched as it disappeared from sight—soon headed to a Louisiana ICE prison.

The Government sometimes makes brief investigative stops to check the immigration status of those who gather in locations where people are hired for day jobs; who work or appear to work in jobs such as construction, landscaping, agriculture, or car washes that often do not require paperwork and are therefore attractive to illegal immigrants; and who do not speak much if any English. If the officers learn that the individual they stopped is a U. S. citizen or otherwise lawfully in the United States, they promptly let the individual go. If the individual is illegally in the United States, the officers may arrest the individual and initiate the process for removal.
