He doesn't think Hegseth is "foolish enough" to give that order? That is the very definition of a failure of imagination.
Rep. Don Bacon on Pete Hegseth: " I don't think he would be foolish enough to make this decision to say, 'kill everybody, lill the survivors.' That's a clear violation of the law of war…If it was as the article said, then that is a violation of the law of war."

Senator Kelly is correct.

Plus a Public Service Announcement:

KEY section of Department of Defense's Law of War Manual is 18.3.2.1.

The VERY rule on the "requirement" to refuse illegal orders gives as its paradigmatic example of what is "clearly illegal:
"orders to fire upon the shipwrecked."

"Neither Hegseth’s statement nor the explanation attributed to Bradley ... makes legal sense.

It cannot be a defense to say, as Hegseth does, that one has killed because one’s objective was 'lethal, kinetic strikes.'"

Anyone found guilty of this will be pardoned by Trump.
Straight up war crime
Every single congressional Democrat needs to be out there, right now, insisting that Pete Hegseth resign right now and announcing that he will be held accountable for committing war crimes.

If you do not demand accountability here and now, they will only become more emboldened.

USDA quietly said Friday it will, after a century, end the Farm Labor Survey (FLS), the only wage survey of ag employers.

FLS is a critical input to setting local minimum wages for H-2A visa workers to try to avoid harm to U.S. workers' wages.

FWIW, 98% of criminal cases in this country end in plea bargains.
I agree with this sentiment completely. Juries are wrong plenty of the time, but they are basically incorruptible, and not a single juror has ever worried about being reelected or reappointed to the position.
