This is no different than refusing to allow Obama to appoint Garland to the Supreme Court because a new president would take office in ten months, and then confirming Barrett eight days before the 2020 election. There are no laws, no rules, no norms, only Calvinball.
The word "eve" is doing a lot of work here in the Court's 'decision'

This is the small open boat Team Hegseth bombed and then bombed again. It's almost 1700 miles by sea from Trinidad to Miami. There is no way this boat was headed for the US.

At least one other boat, the one with the Colombian fisherman, was adrift and displaying a distress signal with its engine out of the water. To attack a disabled vessel in distress and signaling for assistance is basically in the same category as killing shipwrecked survivors clinging to wreckage.
