OK, I’ve finished marking up the per curiam opinion, and this is one of the worst opinions I’ve read this year.

It gets some things just flat out wrong, it works overtime to only provide Trump-friendly facts, and it stretches Newsom (the CA NG 9th Cir opinion) to the breaking point.
BREAKING: Ninth Circuit panel, on a 2-1 vote, allows Trump to deploy National Guard troops in Portland during litigation. Both judges siding with Trump were appointed by Trump in his first term.

Yeah, there’s a lot of conflation of “Dems are deeply unpopular right now” with “left-leaning ideas are unpopular”, but survey after survey shows those ideas are actually a good position to stake out. No one likes the Dems because they won’t support the very popular left-leaning ideas!

Multiple people have criticized me for not accepting that both "the ACA is better than what came before" and "we could have something a lot better" can be true.

There's really no need to import the worst Twitter behaviors here.
Hating the ACA is similar to hating on vaccines.

It's a luxury borne of not really appreciating what existed before.

The fix wasn't perfect, and there is a lot more that we could do to make it better.

But the "ACA Was Bad" Discourse is just untethered from reality.
