FUN FACT: The part of Section 8005 underlined in light blue is legislation on an appropriations bill.

How? B/c it grants authority to transfer funds not appropriated by this bill.

CAVEAT: It's _possible_ there's a precedent that says it's not, but even if so 😳, my Fun Fact stands.

Not that Trump/Vought/Hegseth gaf, but among other ways in which the law says this may NOT be done:
A) The part of 8005 I've underlined in green says money transferred to another account is "available… for the same time period" as that other account; that other acc't expired on Sept 30.

B) 8005 no longer exists. Yes, the funds in multi-year accounts from which funds might be transferred exist, BUT the authority to transfer those funds into payroll accounts that would be granted by 8005 on expired Sept 30, same as bill that enacted 8005 – ie, the FY2025 defense approps bill.

This is a lie. Either that, or JD Vance is an idiot. The problem with paying the troops has NOTHING to do with a lack of cash. It's a lack of legal authority to spend the cash, so tariff revenue has NOTHING to do with this.
