Umm… good question as well, and this is where I leave my libertarian youth behind. Should there be limits on democratic control of individual rights to movement and commerce? I think there should be depending on what and how much. But guys like Peter Thiel say there shouldn’t be limits at all.

Ideal? No. But the best we can do is make the system of requesting passage and residency as simple and respectful to human rights as possible. Westphalia may not have had any democratic representatives, but it was the first time territorial sovereignty was defined beyond the whims of a monarch.

Request is made to the destination country’s government to receive its citizen. It’s a request made as a matter of respect to the people there who have a stake in who is in their country. Why is this necessary? Because it’s human nature to define yourself as a member of your nation/tribe/community.

Excellent question! And might I say an impressive libertarian one at that. The problem with the basis of your question is that it ignores the psychic satisfaction of being a member of the nation. And to be a national, you have to define yourself as such against someone who isn’t (foreigner).

I used to be a big open borders guy. And it’s firmly correct that the most *optimal* policy would be so. But the best argument against this comes from Nassim Taleb and the idea of a country being a “museum-state” to locals who have a stake on who gets in. It’s the same everywhere.

We can have prioritized immigration enforcement without the whole “violation of human rights” thing. We can have reform where landscapers and nanny’s get to legally stay while deporting those who are bad. We just choose not to because Trump and his goons like to be cruel.
