It just feels like the judge decided a surname is some kind of patriarchial property label that *must* be applied apparently. No real consideration of the rights of the child but the father seemingly gets to claim 'his' child. So very wrong.

I’ve just read the judgment… the courts, both at first instance and on appeal, gave virtually no reasons beyond criticising the Cafcass officer for not doing her job and speculating that the child might prefer the surname. wtf?
The courts are forcing a 6 year old girl to keep the name of the man who raped her mother.

No survivor should face harm from the very system that is meant to protect them. No child should have to carry an abuser’s name.

This is an adequate summary of the EHRC’s position on how Schedule 3 to the Equality Act 2010 operates. 😂👍
So the idea would be that Schedule 3 para 27 say protects a women’s refuge from a cis man alleging sex discrimination because he’s denied entry? And the risk now is that the cis man says “But you let in my ex with her baby son; and a trans woman stayed last month without you even noticing. Lawsuit!”
