JUDGE DAVIS: “.. There has been an undeniable move by the Government in the past month to defy court orders or at least to stretch the legal process to the breaking point in an attempt to deny noncitizens their due process rights.”

BONUS RULING: Judge Thomas Johnston, a George W. Bush appoiintee in West Virginia, used a recent ruling to warn of the dangers of defying due process for immigrants because of what it could also mean for Americans. It's worth a read.

Horrifying development. Undocumented immigrants held in the 5th Cir. may be detained indefinitely with no right to even *ask* for bond. The admin will now immediately transfer detainees to Texas, regardless of where they are from, because if they were held anywhere else they *would* have that right.
“Late Friday night, the Fifth Circuit adopted the extreme minority view—that the government can indefinitely detain without bond millions of non-citizens who have been here for generations; who have never committed a crime; and who pose neither a risk of flight nor any threat to public safety.”
208. The Fifth Circuit Jumps the Immigration Detention Shark
Late Friday, two of the nation's most right-wing circuit judges adopted an odious legal claim that district court judges from across the country (and ideological spectrum) have overwhelmingly rejected

Masked goons are a horrendous idea for the same reason anonymous comments sections on the internet turn into a nightmare - vile people are much more likely to say or do heinous shit if they don't think anyone will ever find out it was *them* doing it. Except now they have guns instead of keyboards.

Correction: "left-middle-right spectrum." Someone needs an editor - and a decent night's sleep.
We are taught to think of ideology as a left-middle-center spectrum that overlaps with Dem-Ind-Rep when real people just don't work that way. People we need to be the Democratic base - not merely as voters but critically as volunteers and evangelists - are viewing themselves as independents.

Another example of how the rule of law is slipping away in Minnesota. ICE and the executive branch are basically doing whatever they want, regardless of the law. The district court has tried to rein them in, but is mostly being ignored. And Le's meltdown just highlights the whole clusterfuck.
If you want to read the transcript of the February 3 hearing where Julie Le had her "this job sucks" meltdown, now you can:

This is unreal. An AUSA talking like that in open court is about as close as you can come to a total breakdown. Never heard of anything like it.

Republicans love adding seats to state Supreme Courts! They've done it three times in recent years. This latest court-packing plan will shift Utah's high court far to the right and possibly flip rulings on abortion and gerrymandering.

Democrats should take note that Rs have deemed this acceptable!
This hasn’t received nearly enough attention:

Republicans just passed a law to pack Utah’s Supreme Court after it ruled against their congressional gerrymander.

Cox could appoint two more justices before the court hears the GOP’s latest appeal to preserve their gerrymander
Utah governor signs bill adding justices to state Supreme Court as redistricting appeal looms
Once the new seats are filled, Gov. Spencer Cox will have appointed five of the seven justices.

President Trump has filed a lawsuit against the IRS, in which he demands that the IRS, which he as president controls, pay him $10 billion.

Why are more people not freaking out over this? It's not even on NYT's website today. Federal agents interfering with state election records. Next thing will be a drum beat of lies, parroted by idiots in the media, about "fraud." Then federal agents will be sent to do real interference in November.
Ossoff: "This is a seismic event. This should have people across the country absolutely shook. This is a huge deal. This is an FBI raid on the Fulton County Elections office ... This is a shot across the bow at the midterm elections. He tried to steal power when he lost it in 2020."

An extraordinary document. Read it.

“Attached to this order is an appendix that identifies 96 court orders that ICE has violated in 74 cases. … ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence.”

The testing ground for Bovino’s Operation At Large was Los Angeles. A California judge initially prohibited ICE/CBP’s most flagrant constitutional violations. SCOTUS overruled her 6–3, handing Bovino a blank check to inflict unspeakable brutality on Chicago and Minneapolis. The 6 bear so much blame.
BREAKING Greg Bovino has been removed as Border Patrol "commander at large" and will return to El Centro Calif, where he is expected to retire soon. A stunning turnaround after Pretti killing. Bovino's traveling blue city crackdown is over www.theatlantic.com/politics/202...

A federal judge effectively ordered the U.S. government not to cover up evidence that it illegally executed a civilian, at the request of local prosecutors seeking to investigate federal agents for murder.

Don’t want to overstate things but it feels reminiscent of the run-up to the Civil War.
Understand that 370 days ago even bringing a motion like this would probably have been treated as sanctionably frivolous

Today it was granted ex parte

Judge Shiltz (Bush appointee) lays out how the admin is attempting to sidestep all law and district court precedent (and him!) to make punitive, politically motivated arrests in MN. And how it now appears that a judge on the 8th Cir. is stepping in with no explanation a la SCOTUS to let them do it.
A magistrate judge found no probable cause to support arrest warrants for 5 people involved in the St. Paul church protest.

DOJ appealed to the 8th Cir.

That appeal led to this remarkable letter from the Chief Judge of the Minnesota district court…

Critical. And also it's the Roberts Court, nothing supreme about it. In trying to get folks to see Court role, it's vital we not imply it's a venerable, unchangeable, institution. It's people making decisions - other courts have and can make other decisions.
Don't forget the Supreme Court's role facilitating ICE's brutality and racism in Minneapolis. SCOTUS lifted an injunction that limited racial profiling in immigration enforcement on Sept. 8. The federal assault on Chicago began the next day. Then came the Twin Cities. SCOTUS greenlit these horrors.
