This is to get around an increasing number of court orders requiring DHS to follow the plain words of the law which says administrative warrantless arrests are only for people “likely to escape.” So now they’re saying anyone who refuses to wait for a warrant to be issued is “likely to escape.”
(2) to arrest any alien who in his presence or view is entering or attempting to enter the United States in violation of any law or regulation made in pursuance of law regulating the admission, exclusion, expulsion, or removal of aliens, or to arrest any alien in the United States, if he has reason to believe that the alien so arrested is in the United States in violon of any such law or regulation and is likely to escape before a warrant can be obtained for his arrest, but the alien arrested shall be taken without unnecessary delay for examination before an officer of the Service having authority to examine aliens as to their right to enter or remain in the United States;

Ernesto Padron, a Border Patrol Agent from Brownsville, TX, was arrested in 2010 for possession of CSAM. A case backlog meant the statute of limitations expired before he could be tried. In 2020 Padron was hired at a Texas migrant shelter where he worked directly with unaccompanied migrant children

The Virginia legislature today passed four constitutional amendments, all by day 3 of 2026 session:

—protect abortion rights
—repeal the same-sex marriage ban
—allow mid-decade redistricting
—greatly expand voting rights restoration.

These will all go to 2026 referendums.

ICE is continuing to seek more technology. Last week, the agency published a request for information for ways to better acquire and integrate so-called big data and advertising tech into its operations, saying it was “working with increasing volumes of criminal, civil and regulatory administrative documentation from numerous internal and external sources.” The questionnaire asked vendors to describe the types of data they could provide on “people, businesses, devices, locations, transactions, public records.” It also asked vendors how their systems could help “identify subjects, entities or locations of interest” and whether people could be searched by identifiers including “name, phone, device, account, location.” Justin Sherman, a distinguished fellow at Georgetown Law’s Center on Privacy and Technology, said the request showed ICE was “doubling down” on buying sensitive data.

A Minnesota woman observing ICE agents in her car was cornered on one-way streets. An agent approached, called her by name—citing facial recognition. Days later, her Global Entry and TSA privileges were revoked, with no explanation.
