That said, for the reasons explained above, Defend- ants’ request to stay the October 7 order granting Plaintiffs’ Rule 60(b)(5) motion to modify the Consent Decree is DENIED. Turning to the 13 class members and approximately 442 “potential class members” who are the subject of the No- vember 13 order, as to those individuals who were arrested pursuant to an I-200 warrant, Defendants’ request to stay the November 13 order pending appeal is GRANTED. As to those individuals, who were arrested absent a warrant, Defendants’ motion to stay the November 13 order is GRANTED pending individual violation determinations pursuant to Section IV(E) of the Consent Decree.15 During oral argument, Defendants requested that the court stay this order for 14 days to permit Defendants to seek emergency relief from the Supreme Court, if necessary. That request is GRANTED. An expedited briefing schedule and oral argument date will be set by separate order.

GOVERNMENT’S MEMORANDUM IN SUPPORT OF DETENTION The United States of America, by its attorney, ANDREW S. BOUTROS, United States Attorney for the Northern District of Illinois, hereby submits this memorandum in support of the government’s request that the defendant be detained pending trial. INTRODUCTION Defendant is a serial rapist who turned his position as a United States Customs and Border Protection (“CBP”) officer into a license to commit or attempt to commit gunpoint sexual assaults and robberies of four different women. All of the victims were of Chinese descent, and they all occurred in the Chicago suburbs. As described in the indictment, on six separate occasions throughout 2022, defendant forced his way into a hotel room where the victims were staying, and either robbed or attempted to sexually assault the victims, or both. At the time, defendant was employed as a CBP officer, primarily assigned to O’Hare Airport. Defendant used his service weapon, badge or credentials, as well as the power of his position, to force the victims to perform oral sex, to submit to vaginal sex, or to provide him with cash. One of the victims, Victim B, was attacked on three separate occasions by defendant.

Camden had its first murder-free summer in 50 years. We drove down crime, took violent offenders off the streets, caught terrorists, and put away child predators. While I was focused on delivering real results, judges in my state took advantage of a flawed blue slip tradition and became weapons for the politicized left. For months, these judges stopped conducting trials and entering sentences, leaving violent criminals on the streets. They joined New Jersey senators, who care more about fighting President Trump than the well being of residents which they serve. For four years, I fought against lawfare aimed at President Trump and against politics infecting our justice system. What these obstructionists misunderstood is that my loyalty is not to politics, a title, or a ZIP code. It is to this great country. As a result of the Third Circuit's ruling, and to protect the stability and integrity of the office which I love, I have decided to step down in my role as the U.S. Attorney for the District of New Jersey. But do not mistake compliance for surrender. This decision will not weaken the Justice Department and it will not weaken me. My fight will now stretch across the country. Did someone* try to assassinate Zelensky with drones targeting his flight to Dublin? Because flying four large drones into the expected flight path (the plane was early) looks like an assassination attempt.

*Yes, obviously Russia is the likely suspect, but not literally the only possibility.
