Both said their spouses were able to call them Thursday night, and they believed they were still being held in the basement of the federal building as of Friday afternoon. "She said that she was scared. She was anxious, missed her baby. She just wants to come home," Paul said. "She said the agents themselves were in the detention down in the basement of the federal building, saying, What are we doing here? These aren't the sort of people were supposed to be arresting.” "They hadn't given him anything to eat or any information," Hestmark said. "They gave him a mat and a foil blanket to sleep on." On Nov. 22, Vahid Abedini, an Iranian Studies professor at University of Oklahoma, was boarding a flight to attend the Middle East Studies Assn mtg in Washington, D.C. when he was detained by ICE.

OU Prof Joshua Landis says "he has been wrongfully detained because he has a valid H-1B visa."

As the letter notes, the U.S. has "long branded itself" as a leader on the values of freedom of speech and association "on the global stage". But now: 4/5
Students and faculty at American universities have now been arrested, detained, and even deported in retaliation for their speech and other expression, frequently without basic due process. The State Department has instructed consular officers to conduct intensive reviews of protected speech on social media, with the express purpose of punishing visa applicants and holders for their lawfully-expressed views. These actions all have the same effect: punishing free speech and association and side-stepping due process while depriving the American people of the opportunity to hear a diverse range of views and stripping the United States of one of its greatest sources of soft power.

Judge Currie rejects AG Bondi's attempt to bless the indictments after the fact:

"It would mean the Govt could send any private citizen off the street — attorney or not — into the grand jury room to secure an indictment so long as the AG gives her approval after the fact. That cannot be the law."
I have already concluded that Ms. Halligan’s original appointment was invalid and that the Attorney General’s attempt to retroactively bestow Special Attorney status on her was ineffective. As a result, the Attorney General “could not have authorized” Ms. Halligan, who was not an attorney for the Government at the time, to present Mr. Comey’s indictment to the grand jury on September 25. Restatement (Second) of Agency, supra, § 84(2) (stating that if “the purported or intended principal could not have authorized” the challenged “act” when it was “done,” “he cannot ratify” it). The implications of a contrary conclusion are extraordinary. It would mean the Government could send any private citizen off the street — attorney or not — into the grand jury room to secure an indictment so long as the Attorney General gives her approval after the fact. That cannot be the law.

OPINION AND ORDER GRANTING MOTION TO DISMISS INDICTMENT (ECF NO. 60) On September 25, 2025, Lindsey Halligan, a former White House aide with no prior prosecutorial experience, appeared before a federal grand jury in the Eastern District of Virginia. Having been appointed Interim U.S. Attorney by the Attorney General just days before, Ms. Halligan secured a two-count indictment charging former FBI Director James B. Comey, Jr. with making false statements to Congress and obstructing a congressional proceeding. Mr. Comey now moves to dismiss the indictment on the ground that Ms. Halligan, the sole prosecutor who presented the case to the grand jury, was unlawfully appointed in violation of 28 U.S.C. § 546 and the Constitution's Appointments Clause. As explained below, I agree with Mr. Comey that the Attorney General's attempt to install Ms. Halligan as Interim U.S. Attorney for the Eastern District of Virginia was invalid. And because Ms. Halligan had no lawful authority to present the indictment, I will grant Mr. Comey's motion and dismiss the indictment without prejudice.
