The United Kingdom is no longer sharing intelligence with the US about suspected drug trafficking vessels in the Caribbean because it does not want to be complicit in US military strikes and believes the attacks are illegal, sources familiar with the matter told CNN. The UK’s decision marks a significant break from its closest ally and intelligence sharing partner and underscores the growing skepticism over the legality of the US military’s campaign around Latin America.

But at the same time, the Trump administration has proved skilled at exploiting the weak points of First Amendment law—a campaign most visible in the president’s attack on pro-Palestinian foreign students, such as Özturk. Although a 1945 precedent establishes that immigrants within the United States enjoy First Amendment protections for freedom of speech and of association, the government’s expansive powers of immigration enforcement have left noncitizens far more vulnerable to ideological scrutiny. In this sense, the Trump administration may have gone after noncitizen students with such force in significant part because they made for easy targets. Along similar lines, the Department of Homeland Security recently revoked the visa of Sami Hamdi, a British Muslim political commentator critical of Israel, and detained him for deportation—ostensibly for “supporting terrorism,” an allegation for which the government provided no evidence—while he was in the middle of a U.S. speaking tour.

The first and the second Red Scares both drew their power from fear. Although President Woodrow Wilson ultimately was able to deport only a small portion of the noncitizens arrested during the first Red Scare, those numbers don’t capture the “intimidation resulting in self-censorship” that spread after the raids, Julia Rose Kraut explained to me; she is a legal historian and the author of Threat of Dissent: A History of Ideological Exclusion and Deportation in the United States. In June 1917, in a precursor to the Trump administration’s furor over student protests at Columbia University, three students were prosecuted for printing anti-draft pamphlets. (My great-great-uncle was among them.) Then, as now, government harassment was a warning to others not to make too much noise. Similarly, in the second Red Scare, after a group of prominent screenwriters, producers, and directors—the “Hollywood Ten”—were questioned about suspected Communist sympathies by the House Un-American Activities Committee, the movie industry began quietly paring back film scripts to avoid anything too left-wing.

Andrews: That is not the point that I’m making today. Let me make instead a different point, which is that I think that McCarthyism was actually, in many ways, quite masculine. Think about loyalty oaths. The whole reason why university systems and schools and other institutions wanted to have loyalty oaths, which are sort of the banner phenomenon of McCarthyism, is because they said: We simply cannot have an ongoing atmosphere of suspicion and rumor and sort of witch hunting. We need to have some clarity. So we will have a loyalty oath, and everybody who takes it will be fine. And everybody who doesn’t take it, well, that’ll be a problem. Douthat: [Chuckles.] They won’t be fine. Andrews: They won’t be fine. Douthat: They won’t participate in the argument. Andrews: But at least it then will be done. Then it will be finished, and it will be all out in the open. And the criteria for deciding whether or not somebody is a communist will be known, and we will evaluate them in kind of a straightforward, objective way.

Stephen Miller soon joined a growing list of senior Trump-administration political appointees—at least six by our count—living in Washington-area military housing, where they are shielded not just from potential violence but also from protest. It is an ominous marker of the nation’s polarization, to which the Trump administration has itself contributed, that some of those top public servants have felt a need to separate themselves from the public. These civilian officials can now depend on the U.S. military to augment their personal security. But so many have made the move that they are now straining the availability of housing for the nation’s top uniformed officers.

So you have no concern, even to this day, that Joe Biden could serve as President through January, 2029? I did not see anything that would’ve given me concern. But you watched TV like the rest of us, right? I always couch it with this: of course, he was older. Of course, he was aging. He mentioned it. He talked about not speaking as well as he used to. He talked about not walking as well as he used to. No one is saying that he didn’t age, but he is someone that I engaged with. I saw him every single day as his White House press secretary, and he was someone that was engaged, on top of policy, challenging his staff. One could conceivably think that he could do the job through January, 2025, but that it was not wise to think he could do the job through January, 2029, right? It’s not my place to say. What do you mean it’s not your place to say? No, no, no. Wait, I’m answering the question. I did not see anything that would cause me concern. That is my answer. Except the debate, and the other things that everyone saw? What I’m saying to you is the debate for me was one time. I had never seen him like that before.

Earlier this fall, judges rebuked Secretary of State Marco Rubio for taking similar actions against other pro-Palestinian activists. A judge in Massachusetts last month ruled that the Trump administration had used the threat of deportation to systematically silence noncitizens in academia who protested in support of Palestinians. He said the government had violated the First Amendment as part of a broader strategy to stamp out campus activism.
