The decision to suddenly reverse several weeks of rankings and exclude Notre Dame from the college football playoff was so devoid of reasoning, it may as well have come from the infamous SCOTUS “shadow docket.”

As a lawyer with some experience in constitutional law and who has studied history, I can assure everyone that the “unitary executive” “theory” makes as much sense as the notion that the earth is flat.
Kavanaugh pretty much just said this out loud
The practical effect of overturning Humphrey’s will be that Republican presidents can stack the formerly independent agencies with their copartisans and SCOTUS will be cool with everything they do but when a Dem POTUS does the same Roberts et al will declare all those agencies’ actions unlawful.

even if we luck into this scenario, still wildly important for the next admin to be vindictive and vengeful and bring down the hammer on EVERYONE they possibly can while passing a bunch of democracy-enhancing laws and rebuilding the fed govt or we are frankly fucked & will be back here soon
the absolute best case scenario is trump becomes so unpopular that his own party loses faith in his ability to maintain governing power regardless of election rigging, troop deployment, etc, in which case they will cut him loose and make all that stuff even harder for him to pull off.

This is a big deal, although a lot will depend on what #SCOTUS does in the Illinois case (in which we don’t expect a ruling until the week of November 17 at the earliest).

It's become pretty clear over the past 3 weeks and/or 3 years that the "Democrats need to expand the Supreme Court right now" enthusiasts were correct in 2021, and that if and when Democrats regain power, they cannot get caught flat-footed again slate.com/news-and-pol...
The Past Four Years at the Supreme Court Did Not Need to Be This Way
Part of the reason court reform failed in 2021 is that Democrats were unprepared for Ginsburg’s spectacularly ill-timed death.

Today, a DOJ lawyer confirmed that the U.S. plans to deport Kilmar Abrego Garcia if he’s released from pre-trial criminal detention.

The lawyer said the government won’t wait until Abrego faces trial.

Less than two weeks ago, a White House deputy press secretary decried that as “fake news.”

he just argued that “5 million of whose who lose Medicaid have two types of insurance so if they lose one they’ll still have the other.”

I haven’t looked into the 5M figure but I’m guessing a big chunk are Medicare/Medicaid dual eligibles.

the big questions for american democracy going forward seem to be (1) can the GOP actually build the federal police state they just funded, (2) in time to finish before democratic checks can be established, and (3) whether dems gaining power would actually try to stop/dismantle it
