Providers are not "required to comply" with the act; they are just no longer protected by the exception in the act. If a provider is sued for allowing a trans woman to use a women's toilet, there are other defences they can use - such as "following the existing guidance" or "complying with another law" or even just "we are doing it, but it's taking time to get the money to pay for it". They may still be protected in other ways. And Sex Matters knows this. That's why they want the old guidance revoked: so they can start suing providers for not following their interpretation of the law. As long as the old guidance is in place, providers have a defence that prevents Sex Matters from suing small pubs and tiny cafes who can't afford to defend themselves and thereby terrorising everyone into barring trans people from using their facilities entirely. If you have read the draft guidance in its entirety, you will know that there is no single way to comply with the judgment in FWS. Every option leaves you open to being sued by someone - either under equalities law or other laws, such as privacy or human rights legislation - so a fair chunk of the guidance is about record-keeping so you can defend yourself if you are sued. Even the people who wrote the guidance know that providers are going to get sued if they follow it. Sex Matters is relying on this: They believe that whoever has the deepest pockets and the greatest willingness to sue will be able to impose their view on the country. Leaving the old guidance in place gives actual legal protection to providers as it offers a defence in court, even if it is not as strong as a statutory defence. So, the best course - from the view of the providers for whom the guidance exists in the first place - is to leave it in place until the new one is ready. And Sex Matters hates that.

Sure as 💩💩 Uber and other apps won’t suck up the other 5% so it will be left to workers to suck up a 5% reduction in their wages. That are already squeezed to a minimum by the apps profiteering.

The government’s plan to add 20% VAT to private-hire rides will push fares up and reduce demand. Riders end up paying more, and drivers face fewer trips and less work. This policy helps no one on the ground.

Much of the problem goes back to bad guidance published by the Equality and Human Rights Commission (EHRC) in 2011. In 2021, 7,893 people joined us in signing a letter to the Committee on Standards in Public Life calling for a public inquiry into the adoption of "Stonewall Law" by public institutions. On 3rd June 2021 the story got into the news. Stonewall defended its approach, saying that it was: "confident in our advice on the Equality Act which is based on the Equality and Human Rights Commission's Equality Act Code of Practice." Now, finally, following the Supreme Court judgment in the For Women Scotland case, the EHRC has admitted that its code of practice for service providers is wrong in law, and has urged the Minister for Women and Equalities to revoke it before it does any more damage. We wrote to Baroness Falkner, chair of the EHRC, to ask why its outdated and legally wrong code had not been withdrawn, following her 16th October letter to the minister. Baroness Falkner replied to us saying that the minister has refused to act: "I can confirm that we received a response from the Minister for Women and Equalities on 11 November. This states that it is not her intention to revoke the 2011 Code before the new Code of Practice is published. The reason given is that the 2011 Code addresses a broad range of issues for service providers, beyond those relating to sex and gender reassignment. Therefore, a gap would leave service providers, individuals and the courts without statutory guidance across all protected characteristics for an unknown period of time." Even in Corbett v Corbett, Ormrod LJ used 'she' for post-transition. Somehow, the judiciary was able to use our pronouns for decades without it creating any supposed appearance of bias, but now it routinely degenders and misgenders us. It's such transparent bigotry and/or cowardice.

1. A landmark study was just published in The Journal of Pediatrics.

It found a 68% reduction in suicidality for trans youth getting HRT.

It also found only 7 of more than 400 stopped taking HRT... and of those that did, 4 still identified as gender-diverse.

This creates a totally rigged playing field. If ministers, lobbyists and a transphobic newspaper all have access - but trans people don’t - that isn’t “confidentiality”. That is asymmetric access designed to control the narrative and exclude those whose rights are on the line.

Those of you who know my work know that misgendering on death certificates has been a preoccupation of mine for several years now. I have been really concerned to hear that even though we now have specific guidance on the issue, there are some Coroners who have not been following it.

The tendency of Coroners to ignore guidance from the Chief Coroner, the reality of trans existence, and the wishes of bereaved parents, and express their own views in the death certificate, is both contemptible and unlawful.

We have a legal team ready to go; we will challenge it in the High Court.
