It's really not brought up enough how any Dem admin following a GOP admin has to spend pretty much its first two years just putting out arson fires set by the GOP before it can even really START to work on its own agenda.

In law school I did and internship at the USAO-EDVA Norfolk. We had two cases involving Somali pirates who attack two US Navy vessels. It...did not go well for them.

But they were picked up after their boats sank, brought to the U.S. and put on trial. Not butchered in the ocean.

The problem with a Constitutional Convention is that Republican controlled states would dominate. Look a the state legislatures. Republicans are in control of significantly more than Democrats.

It exists to the same extent "Advice of Counsel" CAN be a defense to certain crimes - but those aren't things like MURDER where the criminal nature of the conduct is obvious.

It's a defense in situations where someone would be reasonable in relying on their lawyer's advice to take certain actions.
Wild to see Whelan say this, but to be clear the OLC's immunity powers are fake anyway. The "golden shield" idea was made up to justify rampant criminality in the GWBush years, then adopted by Holder to excuse Obama's inaction. It's not in the Constitution, statute, or precedent. It's not the law.
Does Pete Hegseth have a "golden shield" against prosecution in the form of a DOJ OLC opinion? Ed Whelan thinks not.

Alternatively - let's look at the history of juries when it comes to things like say, black men being accused of raping white women.

The jury system is in no way perfect but I think a better solution would be a jury of experts instead of just...random folks.
Having served on a jury in a rape trial, I'd have preferred a judge to decide guilt/innocence than a bunch of people who were sadly incapable of applying any logic to the clear evidence they were presented with and prepared, given their blatant sexism, to see the defence counsel destroy the victim.
