Facial recognition / license plate readers are huge threats to privacy. Law enforcement needs tech tools, but we need very strict and high guardrails. And the courts have to rethink what probable cause means in the digital age.

Comey prosecutors are really scrambling now. Just filed an emergency motion to block the magistrate judge's order that the GJ materials be disclosed.

In it they seem to suggest there wasn't two indictments! But Halligan told the court there was!!

The government’s position is that disclosure of grand jury materials is not warranted under the facts presented to the Magistrate Judge. Indeed, the government believes the Magistrate Judge may have misinterpreted some facts he found when issuing the latest order to release the grand jury materials to the defendant. For instance, whether the defendant has any standing to challenge the Richman materials, the full context of the statements made by the prosecutor to the grand jury, that Agent-3 was exposed to potentially privileged material, and that two indictments were presented to the grand jury. Additionally, the Magistrate Judge acknowledges he “did not immediately recognize any overtly privileged communications.” Dkt. No. 192 at 14. The possible exposure of privileged materials to the grand jury was the primary focus of the Magistrate Judge’s inquiry. Having seemingly settled that issue, the Magistrate Judge turns to premature issues such as suppression that have not even been briefed by the parties.

Right now, under federal statutes, President Trump can call us up as the militia if he sees it necessary, especially for three purposes: to repel invasions, to suppress insurrections, and to execute the laws of the union. And right now, we see all three of those in play. ... And the militia is all of us. So the National Guard is part of the militia, which is why it's completely lawful for him to use the National Guard as he has, and he should do more of that, I think, across the country. ... He could just say given the circumstances of an invasion, insurrection, and resistance against federal law being being enforced, I'm calling up the militia, ordering all the men to come together [in] every county, put the veterans in charge of training and organizing all the other men and just have them stand too and await his orders. He can do that and I think he should do that. And so that's what I'll be advocating for from him. So from the bottom, from down the rank and file, we can let President Trump know that we're ready to serve, encourage him to do that, call us up as a militia, order us all to come together in our counties under his command, which gives you complete legal sanction to do what you're doing.
