You'll see a lot of attorneys say it boils down to "if your name isn't Bivens and you weren't detained by six unknown agents you're probably out of luck."

Which is all particularly disheartening when you see the summary of Bivens itself:

It's not just hard. It actually cannot be done. First Amendment retaliation cases like this were explicitly excluded from Bivens actions by the Supreme Court three years ago. The federal government is legally immune from this kind of case.
You can sue state and local cops, but not the feds.

Police officers who publicly declare that they’ll quit if a mayoral candidate they dislike wins the election are (1) usually bluffing—sure buddy, toss away that paycheck and pension—and (2) exactly the sort of cops cities would be better off without, ones who don’t see themselves as public servants.

Also, disability education USED to be a Republican value. Republicans like Dick Thornburgh didn't want people with disabilities to be victims or wards of the state. Educating people with disabilities and ending discrimination would be a path to jobs and to work.

There's already huge issues with schools treating disabled kids illegally. IDEA - the folks who end up enforcing a lot of this - got gutted. Schools can now confidently discriminate against students with disabilities, since consequence won't come unless the kid's family has sue-a-school money.
