The thing that really strikes me about Larry Summers is that he doesn’t talk about this woman as if she was a person. He just talks about ways of manipulating her into bed. No comments about what kind of person he found her to be. Just frustration at his failure to seal the deal.

That's meaningless without some statutory basis. See eg NY v. FERC, 535 U.S. 1 (2002)(a federal agency "literally has no power to act, let alone preempt the validly enacted legislation of a sovereign State, unless and until Congress confers power upon it.")

But with current SCOTUS, who knows?
