This is such a good point. Using your judgement to, like, not eat a food you are allergic to isn’t “discriminating” against that food. At least not in any illegal way. Applying judgement based on information you have (like historical injustice) isn’t illegal, or even wrong.

They are of course wrong. Understanding how race works in something like, voting, doesn't mean you *must* discriminate against one group or another. But Gorsuch and Brett can't see it that way. Because when *they* "use" race, it's always to discriminate.
