good question. it is almost certainly not the case that the Supreme Court will be done with the opinion in time to force a 2026 redistricting. if they mandate the opposite result, anarchy; everyone redistricts at once in 2027. if they simply change to an intent standard, maps don't change.

This is one reason that I think they won't go for an overt overrule of Section 2, which would give every state an excuse to redistrict immediately. I think they'll swap their standard from an effect test to an intent test, freezing most maps for now (except Louisiana) but making it impossible 1/

yes. first of all, it could not take effect soon enough to affect 2026 if released in June 2026. the thing which this does not mention is that it would also force mid-decade redistricting in Democratic states which cracked their VRA districts. this means fewer minority districts but more Democrats.

Schematically there will be a massive transfer of value from one group to the other group when this question is resolved in the next few years, but because of the uncertainty both sides have positive optionality even if in the aggregate the combination of the two will certainly lose money.

This is also why NVDA is a core financier for all these deals: they are already massively long "can Nvidia make a good next-gen AI chip": by committing to buyback eg unused CRWV chips they have effectively sold calls against their upside-case revenue but not downside-case, which is a lovely hedge.

Separate from the question of "will there be a million zillion dollars of profit", the major question driving deals today is "Do I want to be long expected GPU useful life and own chips now (because shortages will persist) or short it and rent (because they will be obsolete due to NVDA's next gen)"
