The filibuster is a Senate rule. It's not a law. It can (and has) been suspended before. Senate rules have been amended as recently as August.

If you have a majority of votes, you can pass legislation. Nothing is stopping Republicans from reopening the government.

It's that simple.

With 51 votes Senate Republicans could amend Senate rules to carve out a one time filibuster exemption, vote on the budget, send it to Trump's desk and reopen the government.
