What happens to the thousands of previously illegally fired Feds?

You should report on what comes next!!! How long will MSPB take to hear cases? For those whose severance was stopped, will it started with accurate fixes including removing “debt”?

Also, MSPB has a quorum again so the bottleneck there will loosen, if slowly. If this RIF language can be instilled long term, Vought attempt to play Thanos with the federal workforce is over.
Lots of responses to this saying making something double illegal doesn’t matter. True sometimes, but not true here. ADA violations are a huge deal with criminal penalties and there’s easy standing for this one.

The way it's written, that would not be easy and also there is a quorum on the MSPB now and appeals from there go to the federal circuit. I don't think SCOTUS will touch that.

They may lose their pensions even if they are not convicted, if their actions broke federal regulations. It's up to the IGs and MSPB in the next admin. I would expect the unions involved to make a fuss too, to which I say, STFU.

Note that because the federal government is shut down, the Merit Systems Protection Board ( #mspb ) is also shut down and not accepting complaints from federal workers. Workers seeking redress for illegal employment actions can't start the process until the shutdown ends.

This will likely increase the pace with which employees are removed but doesn’t actually lower the bar for removing underperforming employees. And the example Douglas Factor analysis looks like the type that would get the MSPB to mitigate the penalty.

The entire process makes no sense. OSC can make recommendations, but VA can say no. Management gets insurance policies paid for for their lawyers. Our lawyers are a minimum of 100k, plus MSPB takes years if not decades. They bleed us dry with no stay on punishment even though we were substantiated.

FWIW I deleted my “Linda McMahon is a cunt” skeet a while back when I found out I would be a named plaintiff. But the MSPB ALJ refused to certify the class, so you know, fuck that lady and all that.

Yes, they're violating the Hatch Act. No they will not face consequences because the OSC and MSPB have been captured by Trump and the conservative courts.

The Hatch Act isn’t concerned with legislative disputes among elected senators. It applies to election campaigning only. Furthermore, officials can’t be “prosecuted” for violations, cases are referred to the MSPB for administrative action.

This judges blocked previous RIFs, only to be overturned by SOCTUS with a non-opinion, so lets see what happens.
But it is ridiculous to say the case should go to the MSPB when Trump has fired Dem members of the MPSB. Its a kangaroo court now.

Hatch act can't be enforced as lack of a quorum on the Merit Systems Protection Board (MSPB), which has hindered enforcement of the Act. This lack of a quorum has affected the ability of the Office of Special Counsel (OSC) to pursue disciplinary action against some federal employees, as the MSP.

By the time the MSPB resolves pending cases, many employees will have found other jobs. Most people cannot afford to remain out of work while their claims go through the system. And most won't want to leave those new jobs to return to an employer who has spent the last year making their life hell.

They are trying very hard not to show the plans in the AFGE v Trump case …

And now HHS claims again claims coding errors for RIFing people they didn’t mean to …. Not quite how plans are meant to be implemented.

Will MSPB see it as illegal in all individual appeals so there is some relief…
