nature of this admin seems to me to speak to their patriotism & their alarm at what Trump & Hegseth are ordering & others are following. It reminded me of concern that military leaders had during Trump 1.0 & how they tempered his worst instincts. By contrast, Hegseth eggs on the worst instincts. 2/2

Not many people are discussing this implication of article. I’m not military, but as I was reading it, it seemed clear that source(s) would have to be military & pretty high level. For them to leak this info w/what I‘d assume would be great personal risk for their careers given the retaliatory 1/

Every human being in the chain of command who was involved in the commission of this war crime needs to be prosecuted to the full extent of the law. It needs to be understood immediately that "I was just following orders" is going to have the same effect it had at Nuremberg.

“Leave no survivors” is an illegal order

Under the Geneva Conventions, you cannot order the killing of:

Surrendering combatants

Shipwrecked sailors

Wounded or incapacitated troops

Anyone who is hors de combat (“out of the fight”)

Likely Trump does see it as a get out jail free card, but as I see it - immunity doesn’t mean it’s not illegal. It just means the Supreme Court amended the constitution to allow a president immunity from prosecution for official acts.

However, your Alito, Thomas and Robert’s law mileage may vary.

The Trump ‘thinking’ is that he’s immune from prosecution while president so his orders aren’t illegal. I challenge that but it doesn’t protect anyone following those orders.

the uniformed officers who accepted the orders and the operators who carried them out are also in jeopardy. We all get hours of LOAC refresher annually plus large blocks of instruction at staff college and war college

there is no gray here...very black and white case every officer would recognize

It also goes to just how much Hegseth is loathed in the middle and upper officer ranks and senior civil service of the armed forces.

Democrats should commit now to disregarding any presidential pardons issued before charges have been filed. Whether or not Trump tries to sign blanket pardons for officials like Hegseth, they should be arrested as soon as Trump leaves office.
