If we’re going to make post-Trump constitutional changes, I’d prefer something like this - drawing a bright line under certain executive limitations that were presumed to exist before Trump, separating the DOJ further from the president, limiting pardons, and killing unitary executive theory dead
I wrote my anti-Trump constitutional amendment. Honestly, a fun exercise

Creating a military conflict with Venezuela gives this administration a legal "hook" to invoke the Alien Enemies Act. In other words, the foreign war is being manufactured in order to facilitate court deference for its domestic mass deportation policy. It's a Stephen Miller Special.

Senator Kelly is correct.

Plus a Public Service Announcement:

KEY section of Department of Defense's Law of War Manual is 18.3.2.1.

The VERY rule on the "requirement" to refuse illegal orders gives as its paradigmatic example of what is "clearly illegal:
"orders to fire upon the shipwrecked."

One pretty unlikely but possible out from our current crisis is that Republicans manage to get the votes together to vote with Dems to successfully impeach and remove the Tsar’s bad boyars, while feigning continued loyalty to him.

More likely that only happens if things have already collapsed.

Why is this never news? Why are we letting our government agencies do this sort of thing while the news agencies report on hallucinated trade deals and act like everything is normal

The president is about to start a war for no real reason. All of the things he has blamed on the country he’s targeting — fentanyl distribution, “emptying the asylums” and sending patients to the U.S., alignment with Tren de Aragua— are provably, obviously false.

Lots of people are going to die.

"Somebody oughta kill those guys!" is probably the dominant American ethos. There are some bad guys. If we killed them, things would be better. But we can't, because They won't let us. We oughta just go and kill 'em. That would fix the problem.

It is unfathomable that the USG lawyers would sign off on a no-survivors boat strike (no get of jail free card).

There's clear precedent dating back to World War II trial of Germans for that very act, which lawyers know well.

It all boils down to the core weakness of the American system which is that it was written for people who were pathologically violently protective of their own personal power and all the checks and balances are dependent on said people engaging in said pathologies.
i think that we should charge even people who have been pardoned, because there is no conceivable way the founders intended the pardon power to permit the executive to order people to commit crimes and then pardon them for them
