it's the same problem I've always had with affirmative action being about "diversity" rather than quotas.

AFFIRMATIVE ACTION SHOULD BE ABOUT QUOTAS.

Oh look, Neil Gorsuch pointing out a *legitimate* problem with the court's VRA jurisprudence. The Court says race cannot be the "predominate" factor, but Gorsuch asks "what does predominance mean?"

But, by his own admission, Gorsuch is teeing up the next case, he's made up his mind on this one.

THE WHOLE REASON we're arguing the case this year, after it was ALREADY argued last year, is that Roberts couldn't figure out how to get away from the court's own ruling in Milligan. Now, he's figured it out.

Thank you. See, the Republicans are trying to gaslight people by suggesting they're for "no race in gerrymandering." That's just not true. Race is ALWAYS a factor when you're drawing a map.

They are of course wrong. Understanding how race works in something like, voting, doesn't mean you *must* discriminate against one group or another. But Gorsuch and Brett can't see it that way. Because when *they* "use" race, it's always to discriminate.
