They can't elect him this way any more than they could elect another 5-year old child (a literal one). He's not eligible to run for president so he can't be elected; not by the people, not by the electors and not by the House. Also, the word "contingent" isn't in the Constitution.

tl;dr: Dershowitz's theory here is that if a presidential election goes to the House, as it did in 1800, then the president would be "selected" by the state delegations, not "elected." It's that stupid.
