How did we end up in a world where ICE agents are indistinguishable from the Proud Boys who stormed the Capitol on January 6?

VIGILANTE NATION tells the story of the insidious state laws behind MAGA's return to power, and it's out in paperback today.

The cover reads:

"The electrifying story of American democracy and its enemies" -- U.S. Congressman Jamie Raskin

You mean Morrison? UET is usually viewed as coming out of the Meese Justice Department, and that's where Scalia was taking his cues from.
david.noll.org
Yeah the culture of quoting them with fire emojis is kindof lame but people should realize that, like, all of our current First Amendment law started with a handful of well-done dissents.

I think he sees himself as a debater in the sense that his only obligation is to have a comeback for anything seeking to hold his side to account. It's not even bullshit, in Frankfurt's sense, but a rhetorical style designed to produce soundbites and clippable moments, ala Charlie Kirk.

Won't the Court necessarily have to take notice of their race to grant them a remedy? Isn't that exactly the race-consciousness that, according to their theory of the case, courts are not permitted to engage in?
david.noll.org
Has anyone noted the absurdity of the "color-blind" plaintiffs in this case identifying themselves by race?
democracydocket.com
11:28 AM ET: Edward Greim is now arguing on behalf of the "non-African American" plaintiffs in the case. He argued the Constitution is color-blind and the statutes enforcing it should be as well.

When you consider this alongside his efforts to boost far-right parties in Europe, his project seems to be reintergrating Nazism into the domain of respectable politics.

But to describe Nazis as Nazis is, according to Vance, an incitement to political violence.

The current Supreme Court gets 👍🏼👍🏼 from former Sheriff Joe Arpaio "who oversaw a reign of racialized terror in the most populous county in Arizona for more than two decades."

for @slate.com I wrote about Joe Arpaio's view on the SCOTUS shadow docket decision in Noem v. Vasquez Perdomo, the case in which Kavanaugh said it was okay to racially profile people.
“I was vindicated by the Supreme Court of all this shit.”

Thanks, SCOTUS.

Oh I missed that. A shame he wouldn't address the substance of the question.

I'd actually like to see someone ask the vice president whether calling these people Nazis is out of bounds.

POLITICO: “.. They referred to Black people as monkeys and ‘the watermelon people’ and mused about putting their political opponents in gas chambers. They talked about raping their enemies .. and lauded Republicans who they believed support slavery.

I assume the U.S. wouldn't accede to a rule that allowed Venezuela to make that determination unilaterally.

"We can kill narco-terrorists in international waters" does not work as a principle of international law if it is available to only one state.
david.noll.org
Again, the reason you can tell the legal theory underpinning these strikes is b.s. is that, if it were taken seriously, it would allow Venezuela to drone yachts off the coast of Florida.

How can the American people trust their government is working on their behalf when White supremacists have so thoroughly infested the Republican Party? We need transparency and we need accountability. Anyone with White supremacist ties must be identified and fired immediately.

Better Schumer: We know these views are common among many young people in the GOP and that many of young activists have gone on to work in Congress, the White House and federal agencies.

I'm launching an investigation to root out Nazis from our government and I hope my GOP colleagues join me.

Sickening. Revolting. Vile. This makes you want to throw up.

This is the kind of garbage that the worst kind of people say when they think nobody is watching.

And where are Republican leaders from Trump on down condemning these comments swiftly and unequivocally!?

I’m waiting to hear it.
A headline from POLITICO reads: "‘I love Hitler’: Leaked messages expose Young Republicans’ racist chat"

Jon Michaels and I talk in Vigilante Nation about "vigilante capture," or the process of vigilantes taking control of government institutions. The case study we focus on--Shasta County, California--seems almost quaint in light of what's happening with ICE.

Trump said he'd focus on the “worst of the worst," but he's mostly focused on people like Melissa Tran — a MD business owner who's lived here 30 yrs and is a fixture of her community.

Cruel.

I salute all who fought for her release. After months in ICE detention, she's finally home.

No one thinks that, if Congress passed a law providing that tariff rates be set by consulting a Magic 8-ball, that would withstand constitutional scrutiny. Yet we're supposed to pretend that, if the Magic 8-ball rulings are posted on Truth Social, they're legitimate government policy.
