War ja auch nicht absehbar, dass von mir ein Aufruf zu dogmatisch sauberer Argumentation kommt —
aber die Vorschläge, den Schutz der EMRK im Bereich Migration abzubauen, sind nicht nur politische Irrlichter, sondern ignorieren auch die Komplexität des Fallrechts.

Karlsruhe schiebt Gesetzestricks einen Riegel vor. Der 2019 eingeführte § 58 Abs. 5 AufenthG, wonach Abschiebungen aus dem Schlafzimmer nur ein “Betreten” und keine Durchsuchung sind, hat künftig keine Anwendung mehr. Die bisherige Abschiebungspraxis ohne Durchsuchungsbeschluss ist nicht haltbar.
