Under the new conservative consensus on presidential power, Trump is welcome to refuse to investigate when government agents shoot Americans in the face, and he is welcome to try to charge their loved ones with crimes. He can openly blackmail government officials to manipulate the economy or to silence political opposition. No one can stop him from directing the Justice Department to indict his enemies for non-crimes while ignoring or pardoning the actual crimes of his political allies. He is free to be a tyrant, because the boss is the boss. But to me, it seems unlikely that the founding generation, in rebelling against a monarch, was looking to replace him with an even more wretched class of despot.

Solicitor General John Sauer made this two days in a row of me writing about the degradation of DOJ in the second Trump administration. www.lawdork.com/p/dojs-defen...
Sauer, Trump's former personal lawyer, was aggressive in argument, combative in tone, and eager to repeatedly speak over justices (all women justices, by my count) trying to ask questions. After Sauer did this with both Justices Sonia Sotomayor and Amy Coney Barrett, this behavior eventually led Chief Justice John Roberts to step in and tell Sauer to let Justice Ketanji Brown Jackson speak. "Counsel," Roberts said, "please allow the Justice —" At which point Sauer said, "I'm sorry." It was an unusual moment for any advocate before the Supreme Court, but almost unheard of for the Chief Justice to have to step in and correct the behavior of a Justice Department lawyer — let alone the solicitor general. (Notably, there were two former solicitors general also at argument on Wednesday: Justice Elena Kagan and Clement.)

Renee Good Family’s Lawyer: We gave the federal government a letter of preservation last week. We asked them to preserve that vehicle to make sure that it’s stored in a safe manner so that none of the evidence gets altered…That is an example of one piece of evidence that we don’t have access to.

This is actually an understatement—the response was totally unhinged—but I'm glad Judge Novak is highlighting the Justice Department's venomous rhetoric.
Ms. Halligan’s response, in which she was joined by both the Attorney General and the Deputy Attorney General, contains a level of vitriol more appropriate for a cable news talk show and falls far beneath the level of advocacy expected from litigants in this Court, particularly the Department of Justice. The Gestapo was a secret police force. No warrants. No courts. No lawyers. And no appeals. People vanished in the night, not because they broke the law, but because the law no longer meant anything. The knock on the door was the sentence. ICE isn’t that. Not even close. ICE is a public agency enforcing laws passed by elected officials. Its agents file reports. They seek warrants. They lose cases. Judges stop them. Lawyers challenge them. Some detainees go home. That’s not tyranny. That’s bureaucracy, for better and worse. You can hate immigration policy. You can argue enforcement is too harsh, too sloppy, or too broad. You can work to have the law changed if you wish. That’s a republic doing what it’s supposed to do. But when you call ordinary law enforcement “the Gestapo,” you cheapen real evil. You turn history into a slogan and suffering into a metaphor. And once every badge is tyranny, no tyranny is left to recognize. In Mississippi, I was raised to believe words should earn their weight. This one hasn't yet. It throws around the language of dictatorship while living under a system where courts still rule, lawyers still argue, and the government still loses. That difference matters. Because the day enforcement becomes secret, unchecked, and answerable to no one, we won’t need to borrow names from history. We’ll know exactly what we’re dealing with. And we’ll wish we’d kept our words honest.”

I keep seeing posts stating that ICE cannot enter your home or a private business without a judicial warrant. While that is legally correct, in reality ICE routinely violates the law by forcing their way in, often by smashing down doors, before violently assaulting people.

Trumpism is fascism.
