Huge W — Virginia Supreme Court clears path: April 21 referendum can proceed, potentially delivering Democrats a 10-1 congressional delegation. Elias: GOP scrambling for new lawsuits/SCOTUS plays, but they’ll fail.

After the state Supreme Court's order today, Virginia Democrats are now one referendum vote away from a 10-1 congressional map. I suspect the GOP is trying to figure out how to file a new lawsuit or concoct a theory for SCOTUS. Both will fail.

Big update from Taniel: Virginia Supreme Court green-lights April 21 referendum — could deliver 10-1 Dem delegation if “yes” wins.
Court will hear the gerrymandering challenge later (briefs April 13), but won’t block the vote.
High-stakes redistricting fight still very much alive.

The Virginia supreme court just:

(1) agreed to take the case pertaining to Dems' gerrymander maneuver;

(2) scheduled deadlines for briefs on April 13;

(3) says the April 21 referendum can go forward in the meantime.

[So it'll rule after, presumably only if the 'yes' wins.]

The New York Times just launched a new "newsletter about the law and the courts." They are calling it "The Docket."

The Times may not care that Democracy Docket has been publishing "On the Docket" and "Daily Docket" for years, but I believe our 400,000 subscribers might.
