I agree with that - a smart prosecutor would let this one drop but the smart prosecutors are no longer in charge at the DOJ.

(To be fair, a smart prosecutor would have never brought this case to begin with.)

I agree that Crysopt itself is not directly on point, but it discusses a number of circuit-level cases that set out a general rule than an invalid indictment does not toll the statute of limitations.

Part of the issue is that normally this kind of thing NEVER happens. No sane President sends a clown into the courtroom. Having a prosecution get dismissed like this is incredibly rare and is a huge win for Comey and James. If this gets refiled, their arguments about vindictive prosecution remain.

It is true that Americans tend to dress like slobs, to be sure. But isn't always interesting how the moral opprobrium is on the least powerful people in the equation rather than the large systemic forces that make life shittier for everyone?

I would switch 4 and 5, but this seems like a perfectly good list to me. (I also refuse to acknowledge the very existence of Rise of Skywalker in the same way I refuse to acknowledge the existence of Star Trek V. Every franchise gets a mulligan in my book.)
