If a student turned in Trump’s post in my american government intro class, he would fail for not understanding American federalism, but that’s not Trumps point anyway…his point is to undermine the constitution to seize and control power to force compliance with his will, not the law or constitution
A key takeaway from Trump’s rant this morning about mail-in ballots.

is there evidence of harm from tarnishment?

maybe we don't have much evidence of that,* but courts seem to presume it. if so, perhaps constitutional; if not, not.

*linford's own empirical work has found not only no harm, but sometimes burnishment

is protection against tarnishment consistent w/ history & tradition?

is it reasonable related to tm's purpose?

is the provision viewpoint-based?

how liberally should courts use constitutional scrutiny to second guess commercial regulation?

if we get all the way to scotus with the question of constitutionality of dilution law, does it survive?

@jakelinford.bsky.social thinks yes. court doesn't seem to have much appetite for traditional constitutional scrutiny.

Alex argues personal brand is _not_ IP, and we can fit real harms into existing IP and other regimes. Personal brand doesn't necessitate an expansion of rights, and if courts don't figure it out, we'll suffer chilling effects. @lexlanham.bsky.social #ipsc2025
