New from me in @theatlantic.com : Trump is learning that although it's easy to convict someone in a social media rant, when you get into the courtroom things are a bit more complicated.

The criminal justice system is standing up to Trump.

The One Place Trump’s Power Remains Constrained
In the criminal-justice system, when the president’s bluster collides with facts and evidence, he keeps losing.

When I was 12, my older brother decided to make caramel by melting sugar in the microwave. I decided to “test” it.

Lesson learned: hot sugar is very hot and sticks to your finger.
A person's (legit excruciating, not mocking their pain!) post about getting a huge welt and lacerations from an egg hucked at highway speed has me wondering about the most embarrassing food to be injured by. My mom once burned her forehead badly with a flaming marshmallow, might be up there

Congress can immunize witnesses. Then there’s no 5th A right and the person can be compelled to testify. (They still can’t commit perjury during the testimony.)
“Plead the Fifth” regarding what??

Maxwell has exhausted her appellate process. SCOTUS has rejected her.

Regardless, she lied with Todd Blanche so her credibility is dogshit unless you get someone like former AUSA Maurene Comey in there to question her.

Spitballing here but there’s a proceeding to deal with this type of behavior by a party in court. It’s called contempt.
This was the third time that Judge Xinis had ordered DOJ to produce someone who could actually testify to support its claims, and it was the third time DOJ failed to produce someone who could actually testify to support its claims.
ABC News: "After not being able to answer several questions from Abrego Garcia's attorneys, [ICE's John] Cantu said he received 'verbiage' for his declaration from a State Department attorney."

In DC, we have been hearing many of these stories one by one. To see them all in one place, to see that the trickle of corruption is a flood, to see DOJ perverted this way …is chilling.
Gift link to NYT article about the corruption of DOJ. One former insider says “I wouldn’t even call it the Justice Department anymore. It’s become Trump’s personal law firm. … [T]he American people should be enraged.”

Rule 6(e) is pretty clear on this point. MUST BE RECORDED. And govt would have to show an “unintentional failure” to maintain the validity of the indictment.

I’ve been handling criminal matters for 25 years or so and I’m …. at a loss.
In USA v Comey, "for the avoidance of doubt," AG Pam Bondi purports to retroactively appoint Halligan under a different statute and to "ratify" her grand jury presentation & signature on the indictment—a month after the statute of limitation ran out.

Mad Max on the mound for Game 7. Gonna be wild. He’s probably still mad that he can’t bat.
2019 feels like a lifetime ago, but Max Scherzer starting game 7 of the World Series still gives me all the feels. As a fellow old guy I hope he has at least one more special performance in the tank. The matchup with Shohei is absolute cinema.

An excellent (and historically fascinating) thread. We don’t have to give in to divisiveness. We are better together.
JD Vance claims that diversity weakens unions, as people end up distrusting each other and not organizing.

Let me tell you two menswear stories related to this claim. 🧵

15 US states and territories have formed a new Public Health Alliance, which will counter the absence of federal leadership by tracking outbreaks, issuing guidance, buying vaccines and more.

Members of the new alliance include CA, CO, CT, DE, GU, HI, IL, MD, MA, NJ, NY, NC, OR, RI, WA.

Insane things happening in the DC US Attorney's Office.

For those unfamiliar, the office handles both federal cases and nearly all of DC local criminal cases -- like a DA.

USAO got local jury to indict on fed charge and then tried to return local indictment in fed court.

Judge: Um, no.

Speedy trial, here we come. 70 days from indictment so trial could be as soon as Dec 4. Motions practice could slow that down but there’s a strong strategy to make USAO try the case quickly if no career folks are on it and only Hallagan.
As of this afternoon, not a single career DOJ attorney has entered an appearance in the case against former FBI Director James Comey. Only the newly-appointed U.S. attorney is listed. That's extremely unusual.
