You're not getting it right.
What Senator Cotton says here would be a bad defense for the Germans convicted in WWI and WWII war crimes trials -- including for firing on shipwrecked in fully operational lifeboats.

"....the military’s overhead surveillance zoomed in to ensure the survivors weren’t injured or bleeding." I'm not a lawyer, but it seems pretty clear that you're not allowed to kill helpless unarmed survivors of a shipwreck, regardless of whether they're "visibly injured".
