We've written & published a short summary statement regarding the Sandie Peggie V NHS Fife Health Board employment tribunal case & the judgment given yesterday. Much of the media coverage has missed key information, the most important aspect being that all claims against Dr Beth Upton were dismissed

TLDR: the deliberately adversarial relationship between trans people and healthcare providers is enormously harmful, for everyone.

Wonder why trans people don't trust judges? Classic example of testimonial injustice here. Lived experience of the harmful impacts of harassment is denied because the complainant is trans. Our distress is routinely minimised, disregarded and dismissed.

It's an opportunity to highlight the continued struggles faced by intersex people globally, from unnecessary medical intervention or stigma.

We all deserve to be treated with dignity, and live a life free from discrimination.

The thing about terminological arguments is that terminology doesn't actually matter but solidarity and respect for other trans people do. And a lot of people use the former to signal the absence of the latter.

Call for Papers: Special Issue of Feminist Legal Studies Feminist Responses to the Regression of Trans Rights: Strategies, Alliances, Hope Amidst continuing backlash against trans rights, recognition and inclusion, two recent decisions from the UK have substantially impacted not only trans people’s legal status but also legal and social narratives of sex, gender and identity. The narrative that trans inclusion has a chilling effect on the rights of others, particularly women, has been adopted uncritically by both the UK Supreme Court in For Women Scotland and the Office for Students in its finding that the University of Sussex’s trans-inclusion policy had a chilling effect on free speech. These cases highlight a backlash that has been ongoing for some time, and sparks debates and fear of what may lie in the near future for trans people and kin, as well as other gender-variant persons, not only in the UK, but across jurisdictions and in a global perspective. The discourse of the ‘gender critical’ movement is splintering both the feminist and LGBT+ movements globally, with some aligning politically with the Far- and Christian Right against trans rights, adopting their terminology of ‘gender ideology’ and potentially posing a wider threat to sexual and reproductive rights. While this a difficult situation for trans people, kin and allies, this special issue seeks to emphasise that legal battles – including battles (temporarily) lost – are also an opportunity to seek to reinforce old alliances and to form new ones, to find new legal frontiers and imaginaries, to reinforce the theoretical and methodological underpinnings of legal arguments as well as intergenerational memory of what feminist legal work is, has been and should be about. How, we ask, do these decisions (and those like them globally) reflect and reproduce structures of coloniality, heteronormativity and cisnormativity? I hope people understand just how horrifying this is as a trans person.

You could just be getting in with your life, not doing anything to hurt anyone - and suddenly you find yourself dragged into a horrible legal case where the press is painting your going to the toilet as somehow predatory.

Trans case hears of ‘secret toilet’ An engineer began using a “secret toilet” at her workplace after encountering a transgender colleague in the female bathrooms, an employment tribunal has heard. Maria Kelly said she does not want to “sacrifice my privacy and my dignity” by sharing toilets with a man and is taking legal action against her employer Leonardo UK. She has lodged a complaint alleging harassment, direct and indirect discrimination. Ms Kelly, people and capability lead for the aerospace firm’s electronics department in Edinburgh, said that as someone who suffers from heavy periods, female toilets are important to her as a place of refuge and privacy to deal with them. She told the tribunal in Edinburgh that after encountering a transgender colleague in the female bathrooms she began using two toilets that only women know about. She added: “I don’t know any man who knows about them. I know women who use them because of the increased privacy.” Ms Kelly said she had first become aware of a transgender person using the female toilets in 2019 when a member of staff from an office elsewhere in the UK came to Edinburgh and female colleagues told her about it, seeming “genuinely upset”. She said she did not raise the issue with the company at the time as she feared being labelled “transphobic” or being put on the “naughty list”. Her lawyer Naomi Cunningham asked her for her understanding of what constitutes a man and a woman. She replied: “It’s always been related to sex, so it’s the sex that you were born, so if you were born male you remain male and if you were born female you remain female.” The tribunal continues.

Who are we: we are a trans-led grassroots group, offering confidential and non-judgmental support and information to increase safety and reduce harm to trans people in our city. Our focus will be led by community needs (initially around safe DIY HRT and mental health). who are we: we are local volunteers with no current funding or official affiliations. We are not a crisis service. Responsiveness will vary depending on volunteer capacity. Examples of how we can help: HRT: info about different forms of HRT, what to expect, common side effects, accessing and understanding blood tests.
