The 1st amendment (which does many good things) is a great example of how everything is just a gentleman's agreement that will be enforced and interpreted based on who holds power in society.

It's worth noting this in the context of the "An assault on our ancient liberties" discourse around the plan to curtail jury trials. The UK justice system has always been anti-democratic and indulgent of the security state. Authoritarianism is built-in.

I've been reminded of the 2nd person sections in Complicity by Iain Banks and damn, they're quite something.

Shocking and disturbing but not in a cheap way. A really effective use of a type of language not used in fiction combined with imagery that would be unsettling regardless.
