Some reflections on the Sony v. Cox oral arguments (but read @mrose.ink's live posts for more detail)!

The facts for Cox looked bad. Clement, for Sony, made reference three times to what he called the "F the DMCA" email sent by one employee (which did not, in fact, say "F"). 1/
And we're off with SCOTUS arguments in Sony v Cox. The question at issue: whether ISPs can be liable for the copyright infringement committed by their users.

Justice Sotomayor has the DMCA very, very wrong. She reads it as a statute designed to preserve liability for platforms, not as one designed to shield them from it so that they can exist to facilitate user expression.

AND she and Jackson impose extremely modern (c) law on its statutory origins.

The best way to understand the current regime is that we're effectively being governed by an unofficial, extra-constitutional junta mostly dominated by Miller, in which Trump himself is a marginal and disengaged figurehead making few if any substantive decisions.
