James B. Comey, Jr., by and through undersigned counsel, and pursuant to Federal Rule of Criminal Procedure 12(b), moves this Court to dismiss the government's indictment. As explained further below, the government has singled out Mr. Comey for prosecution because of
his protected speech and because of President Trump's personal animus toward Mr. Comey.
Such a vindictive and selective prosecution violates the First Amendment, Due Process Clause, and equal protection principles. The proper remedy for this unconstitutional prosecution is
dismissal with prejudice. Any lesser remedy would be insufficient in light of the government's
flagrant misconduct and the need to deter the government from bringing further unconstitutional
prosecutions.

James B. Comey, Jr., by and through undersigned counsel, and pursuant to Federal Rule of Criminal Procedure 12(b), moves this Court to dismiss the government's indictment. As explained
in the accompanying Memorandum, the indictment is fatally flawed because it results directly from
a paradigmatic violation of the Appointments Clause and the statute authorizing appointments of interim U.S. Attorneys, 28 U.S.C. § 546. The official who purported to secure and sign the indictment was invalidly appointed to her position as interim U.S. Attorney. Because of that
fundamental constitutional and statutory defect, the indictment is a nullity and must be dismissed.
That dismissal must be with prejudice in order to deter the government's willfully unlawful
conduct.

We are on a dangerous path in America. A panel of Ninth Circuit judges has chosen to not hold the president accountable: they just granted the federal government’s motion to stay our first TRO, which prevented the president from deploying Oregon National Guard troops in Oregon.

Defendants-Appellants, President Donald J. Trump, Secretary of Defense
Peter Hegseth, and Secretary of Homeland Security Kristi Noem, in their official
capacities, the Department of Defense (DoD), and the Department of Homeland
Security (DHS) (collectively, Defendants), seek an emergency stay of the district
court’s October 4, 2025 temporary restraining order (TRO) enjoining the President’s
Case: 25-6268, 10/20/2025, DktEntry: 61.1, Page 2 of 93
order to federalize 200 members of the Oregon National Guard for 60 days to protect
federal personnel and property at the Lindquist Building, an Immigration and
Customs Enforcement (ICE) facility in Portland, Oregon. After considering the
record at this preliminary stage, we conclude that it is likely that the President
lawfully exercised his statutory authority under 10 U.S.C. § 12406(3), which
authorizes the federalization of the National Guard when “the President is unable
with the regular forces to execute the laws of the United States.” The evidence the
President relied on reflects a “colorable assessment of the facts and law within a
‘range of honest judgment.’” Newsom v. Trump, 141 F.4th 1032, 1051 (9th Cir.
2025) (per curiam) (quoting Sterling v. Constantin, 287 U.S. 378, 399 (1932)). We
thus conclude that Defendants are likely to succeed on the merits of their appeal, and
that the other stay factors weigh in their favor. We grant Defendants’ motion for a
stay pending appeal.
