Once upon a time, I tried to negotiate the text of a domestic crimes against humanity law with DoD, who was concerned that it would be used against them.

I told them that was absurd, are you really suggesting that DoD would engage in conduct implicating CAH?

Don’t like the answer to my question.

Arkansas will become the first state to lose PBS.

The state-wide network will switch to local programming in 2026 — after a vote by a board appointed by Gov. Sarah Huckabee Sanders.

The end of federal funding for public media demolishes Arkansas PBS. The station will rebrand as ATV and feature mainly local programming.

The JAG also took the position that the PCA would not apply, emphasizing the military (and not civilian) nature of the need for the deployment.

To be sure, the JAG was clear in the view that the President has inherent authority to use the military to eliminate serious threats to commerce, but for federalization of the militia, this “unable with” criterion had to be met. Also clear that this situation required military, not civilian LE.

It makes clear that, at least in 1917, the military understood “regular forces” to mean the full-time professional military. It also clarifies that “unable” was understood to mean insufficient regular troops were available to accomplish the task at hand.

New filing in Illinois case challenging the National Guard deployment. Prof. Lederman located the full JAG op. from 1917 interpreting the requirement the President be “unable with the regular forces to execute the law.” (I had also been looking for this opinion from the digested ops. Thanks, Marty!)
Supplements/corrections in the National Guard in Chicago case:

In my amicus briefs in Trump v. Illinois, on the Applications Docket (No. 25A443), I cited a 1917 memo by esteemed Army JAG Enoch Crowder that appeared to confirm that the statutory term "the regular forces" refers to the Army. [1]

I am going to be faced with uncomfortable decisions soon. I’m moving forward to the next round in consideration for promotion. We’re also in a budget crunch. I may not be the only candidate up for the posting.
