Yesterday, Martinez' lawyer told the judge the CBP officer had DRIVEN HIS ATTEMPTED MURDER WEAPON back to Maine.

The Border Patrol agent who shot a woman after their vehicles collided in Brighton Park this month has since driven his vehicle to Maine, preventing her defense attorney from examining it as he prepares for trial “as soon as possible,” the attorney told a judge Thursday.

The car is the “centerpiece” of the dispute over the Oct. 4 incident involving Marimar Martinez and Anthony Ian Santos Ruiz, attorney Chris Parente explained to U.S. District Judge Georgia Alexakis.

Now Parente said he intends to ask for sanctions in the hot-button case. In the meantime, Alexakis told prosecutors, “I think you need to get the car back.”

She ordered it returned to Chicago on a flatbed trailer, at Parente’s request.

Kelly O. Hayes, a career prosecutor serving as Trump’s acting U.S. attorney in Maryland, has been facing intense pressure and questions for weeks from Ed Martin, a Trump ally tapped to run the newly formed weaponization task force at the department, about when she will bring criminal charges against Sen. Adam Schiff, D-Calif.

She has chosen to move forward with a case she feels has merit and that will also be welcomed by the White House: to prosecute Trump’s former national security adviser John Bolton on charges related to mishandling classified information. Hayes has told colleagues she believes some charges against Bolton are reasonable and warranted, a case involving mishandling of classified information that began under the Biden administration, according to MSNBC sources.

But Hayes’ office has been interviewing witnesses in a grand jury probe examining allegations that Schiff defrauded a bank related to financing for a second home in Maryland and is bracing for being fired herself when she explains that there are insufficient facts to bring such a case against the U.S. senator, the sources said.

Bovino told Finerty that Sheridan had shoved him, but not that he’d tried to hit him, she told the court. The Border Patrol chief also told Finerty that he’d injured his groin during “the events of the day,” singling out his interaction with Sheridan as a cause for the injury.

Bovino needed an MRI and was ordered to take two weeks of bed rest to heal the injury, Finerty said. Bovino has continued his regular television and other media appearances since Oct. 3.

permitted to testify while informing that Mr. Hott is no longer going to be assigned to the
“Chicago area of responsibility” is actually today—one business day before this Court
has directed he testify about these incidents, and one day after Plaintiffs sought his
deposition for the preliminary injunction hearing. Dkt. 55 at 2 n.2. How convenient.
5. Plaintiffs object because the government should not be allowed to play a game of hot
potato with its different agencies using force against civilians in this District. Operation
Midway Blitz presumably has a chain of command. Bovino, Hott, and Parra appear to be
within that chain of command, and the government has submitted evidence in this and
other pending cases that these individuals have knowledge of and authority over the
operation. See, e.g., Dkt. 54 at 4-5 (collecting sources about Bovino’s involvement); Dkt.
35-1 (Hott Declaration); Dkt. 35-9 (Parra declaration).
6. This Court should reject the government’s effort to substitute someone lower down the
chain of command withing CBP. This Court should order Hott to appear as an ICE
supervisor, particularly given that the government has not represented in its filing that
ICE was uninvolved. To the extent that the government is representing that a CBP
supervisor is necessary, then this Court should direct Parra to appear as a CBP supervisor,
in addition to Hott. To the extent that Court needs a single witness, Bonvio appears to be
the functional commander of Operation Midway Blitz. See Dkt. 54 at 4-5.
