I have emailed the BSI for guidance as to the standard man and woman.

Hopefully they can help with this urgently so we can ensure we are compliant with the EHRC’s guidance.
BSI man and woman. Dear BSl, I am writing to you as a service provider whose business offers services to both men and women. I have an urgent question I need answered as I fear at present I am open to legal action by offering service to man and women based on the latest guidance from the EHRC. The EHRC states that single sex services should be offered and accessed based on "appearance and behaviour" So l ask you as the British Standards Institute, a highly respected organisation that has for years protected the British public by setting standards of many things encountered in every day life if you can help? I cannot find the single standard for what a woman's appearance and behaviour is to allow me to provide my service and remain compliant to the • 'o same question in react ard is for them. Can any legal expert please define what the law defines as female “appearance and behavior”.
After all if this is to be used to exclude people is surely must be defined someplace formally so as to bring real clarity that Starmer claimed the F(s)WS case provided.

Dear Alison, Thank you for contacting the Cabinet Office on 29 September about the implications of the Supreme Court's judgement in the For Women Scotland case. I am responding on behalf of officials from the Office for Equality and Opportunity within the Cabinet Office. Please accept my apologies for the delay in responding. The Government is clear that it acknowledges the deep concern and anxiety many people are feeling following the recent Supreme Court ruling and its potential implications for trans people. In its judgment, the Supreme Court announced on 16 April it had determined that the terms 'man', 'woman', and 'sex' in the Equality Act 2010 refer to biological sex. It ruled that a Gender Recognition Certificate does not change a person's legal sex for the purposes of the Act. There, of course, remain protections in place for trans people to live free from discrimination and harassment and have their acquired gender recognised. Trans people continue to be recognised in law and should be treated with the same dignity and respect as anyone. That was true before the ruling, and the Supreme Court has underlined that fact. They are still protected from discrimination and harassment in the Equality Act and those with a gender recognition certificate (GRC) are still rec-ognised in their acquired sex and gender in other circumstances unless specific exceptions apply. A GRC still allows people to legally change their sex for a range of reasons that matter in their lives - birth, death, marriage and civil partnership certificates, for example. We'll look at gender recognition reform, but we're clear that we will always support single-sex spaces based on biological sex. The Government recognises that the application of the Supreme Court ruling in some settings is complex. That is why the independent Equality and Human Rights Commission's (EHRC) Code of Practice for Services, Public Functions and Associations is important — to provide clarity and confidence for service providers in applying the Equality Act 2010 on a day-to-day basis. The EHRC has revised its Code following the six week consultation and submitted it to the Minister for Women and Equalities. The EHRC is an independent regulator, and the Government respects its independence and the role it plays as the equalities reg-ulator. The Government will consider the draft updated Code and, if the decision is taken to approve it, the Code will be laid before Parliament. Parliament will then have a 40 day period to consider the Code. You also asked the Government to ensure the UK does not fall into breach of its human rights obligations. It is important that any content included in the draft Code takes into account all relevant legislative frameworks and is practically applicable for duty bear-ers. You may find some reassurance in learning about how this Government is working to increase protections for trans people. It remains committed to protecting trans people, ensuring that they are treated with dignity and respect. The Government is proceeding with its commitments to deliver a full trans-inclusive ban on conversion practices, equalise all strands of hate crime, and review health services to ensure that all trans people receive appropriate and high-quality care. For clarity. The EHRC’s role is to monitor, promote, and enforce compliance with equality and human rights law, while the courts and police uphold the law itself under the authority of the Crown.

Did the head of the EHRC just basically threaten every company and service provider in the country with this?
It definitely read as a threat, comply to our demands ( no matter how disgusting they are) or we will take you to court.
Implementing the law may have some unwelcome costs, but contesting litigation through tribunals and courts will have different financial and reputational costs too.

Noticed this from the Darlington reporting..
Whiteness stating that the trust had and probably still has a policy to segregate trans women into separate rooms. If that’s official trust policy it is that just these nurses further discriminating?

Maybe something to look into?
One of them was Kirsten Coutts, who has worked at Darlington Memorial Hospital since 2008. She said that while she did not know Rose Henderson or use the same changing room, she found the situation "unacceptable". "When we look after patients, we are not allowed to put transgender patients together with biological women at any point in their stay at the hospital," she said in her statement. "They are always placed in a side room. This is obviously a sensible rule and it is not reasonable or fair to deny the same right to privacy to the Trust's own staff."

JR: Opinionpollcatcat says it's been five months since the Supreme Court ruled that sex in the Equality Act means biological sex. Why does the NHS still operate policies that state that male adults and children will be admitted to female wards, changing areas and toilets if those male people identify as trans, and she works in an NHS Trust where that's still happening. WS: So I don't think it should be happening, and we're still waiting for the EHRC guidance, but on single sex spaces, before we get to the gender identity issues, on single sex spaces, more generally, are seeing far too many breaches. I mean, Karin Smyth, the Minister for Secondary Care, is all over this, because even if put to one side the gender identity issues, there are far too many cases of men and women being on the same ward, and it's not appropriate, dignified or safe. So we've got to deal with that. That is often about capacity constraints, resources. So l've got to be honest with people watching, it's going to take time to eliminate that, but the objective is to eliminate it. Then we get onto the gender identity issues. Now I think this is primarily an issue about women's rights, voices and spaces, that's where the real tension and conflict has arisen, and so we've got to make sure that the guidance has real world application. I don't think anyone, for example, would think it desirable for a trans man, so someone who's born female, but to all intents and purposes, you know, hairy arms, beard, voice, identity, then wanders into women's toilets or goes to a women's ward or another women's space. I think that would be undignified and unpleasant for everyone concerned, this is really about women's rights, voices and spaces. That's where I think we've got to try and find a way to make sure that trans women are a space that is dignified and safe and inclusive for them, that doesn't impact on women's sex based rights and spaces... JR: That sounds like third spaces? WS: I think, I think for trans women, yes, I think that is where we're looking. And I know there will be lots of people, probably some Mumsnet users, and there'll be lots of people in the LGBT community and allies who would say that that's outrageous, I can't believe you're even saying that, and you're a gay health secretary, how could you countenance this? I'm trying to find a way through on this that maybe not everyone loves, but everyone can live with and treats people with dignity and respect. And I think where this conversation went so badly wrong was a lack of understanding of why, in a women's rights context, the majority of our population who fought for generations for those rights, voices and spaces feel strongly about protecting them. And I think the, you know, I understand obviously, you know, being a gay man the context of LGBT equality and the struggles that our community has been through. But I don't think there's been nearly enough dialogue, empathy and understanding for different perspectives. I think we're getting to a better place as a country now, and if we can do that in a way that's level headed, rational and considerate and compassionate, I think we'll be in a better place and will arrive at common sense.
