This ICE agent used a chemical agent against a person who, it appears, merely pointed at him.
That potentially is assault.
Their conduct carries some immunity from prosecution. But at some point, local authorities need to test that protection as they see what ICE is doing in their communities

This is now internal cover-ups work as the country has seen before
