Implementation of ECtHR judgements isn't only about acknowledging the problem and compensating the applicants- it's most importantly about addressing the key underlying problem. Poland won't be able to do that anytime soon, and ECtHR faces an headache that will only grow. 7/

Even if Poland manages to remedy the core issue - the independence of the National Council of Judiciary, by appointing new judges-members of the Council once the term of the current politicised lot expires in 2026, the neo-judges will still be out there. 6/

A lot of people angry about how ECtHR deals with systemic problems will be very unhappy if the famously clogged court gets bogged down even further in an avalanche of cases whose source won't end anytime soon. 5/

But how long can it do so? If Poland can't fix the problem by Nov 2026, ECtHR might face a dilemma - postpone further, or open an event greater floodgate for applications - Poles are famously litigious, and won't hesitate to "go to Strasbourg" due to a neo-judge in their courtroom history. 4/

Behind the scenes, quietly, the Polish government is settling cases with applicants who claim the lack of independence of neo-judges at the Supreme Court, as the ECtHR has been crystal clear about the status of such judges. Jury is out on judges in lower-level courts, and ECtHR is holding off. 3/

With now over 1100 applications against Poland regarding neo-judges, the government keeps promising to remedy the issue, but with President Nawrocki on a warpath against Tusk, the chances for a speedy remedy are slim. Applicants are waiting for justice, and neo-judges aren't going anywhere. 2/
