I guess this is what happens when all the competent lawyers are fired vindictively or quit in protest.
UPDATE: Another judge just dinged DOJ in another trans care subpoena case, with Judge Joun finding that DOJ missed a deadline, and, accordingly, their motion to alter the judgment in the Boston Children's Hospital case was "untimely." And, because DOJ also appealed, Joun has no further jurisdiction.

I'm not a lawyer, but it seems pretty cut and dry that communicating to the military "remember your oath" and then the president claiming this is seditious is an endorsement from the president that soldiers should violate their oaths, which is itself a much clearer violation of 18 USC 2387.
The Trump administration is abusing the military justice system to target its political opponents. A despicable new low for a group that strives everyday to find the moral bottom.

The circuit judges seem to be critical of the entire idea of a "press pool", treating it as an arbitrary distinction from by-invitation events. Their line of questions against the AP lawyer are all along the lines of "does the president not have a right to specify who is allowed in his office?"
This DC Circuit argument in the AP case isn't promising. Judge Wilkins is sympathetic to AP but for the wrong reasons. Meanwhile, Judge Rao wants to expand the "rule" barring injunctions against the president into a rule barring injunctions against anyone whom the president might ask to do things.
Tomorrow morning, the DC Circuit will consider whether Trump violated the First Amendment by ejecting @apnews.com from the White House press pool after it refused to call the Gulf of Mexico the Gulf of America. Very glad that the AP is fighting this. knightcolumbia.org/blog/the-fig...
